Elon Musk Says He’s Filing for Full Custody of Son with Ashley St. Clair After She Changes Her Views to Support Trans Community

Elon Musk says he’s filing for full custody of his son with Ashley St. Clair after she apologized for her past transphobic remarks.

According to a post on X on Monday, Jan. 12, the Tesla CEO, 54, said he’s going to attempt to get full custody of the son he shares with the influencer and author, 27.

“I will be filing for full custody today, given her statements implying she might transition a one-year-old boy,” Musk wrote in a post on X, replying to another user who implied the billionaire mogul should file for full custody after St. Clair changed her views to support the transgender community.

Reps for Musk and St. Clair did not immediately reply to PEOPLE’s request for comment.

Despite Musk’s claim, it’s not clear if St. Clair ever said she planned to have their son transition. Instead, she apologized publicly for past remarks she’s made about the transgender community.

Over the weekend, St Clair — who revealed last year that she welcomed a baby with Musk in September 2024 — responded to a user on X who asked her to address her “blatant transphobia” in the past.

“I feel immense guilt for my role. And even more guilt that things I have said in the past may have caused my son’s sister more pain,” St. Clair wrote, seemingly referring to Musk’s daughter Vivian, who is transgender.

“Idrk how to make amends for many of these things but I have been trying incredibly hard privately to learn + advocate for those within the trans community that I’ve hurt,” she continued.

St. Clair said she hasn’t previously spoken out about her support for trans rights since she’s gone “back and forth” over whether her voice would be helpful on the issue, since it’ll be framed as “disingenuous.”

“Even this reply will become right wing hysteria but yeah I am sorry,” St Clair added. “Let me know how I can help.”

In August, St. Clair got candid about her ongoing custody battle with Musk and shared that the past year for her has been “unplanned career suicide.”

“Well, after a year of unplanned career suicide, many questionable life choices and a gap in my LinkedIn profile that cannot be legally explained, I’ve decided to start a podcast,” St. Clair said in the first episode of her podcast Bad Advice on Musk’s X platform.

St. Clair then claimed that she decided to start the podcast because she is “getting evicted.”

“Polymarket offered me $10,000 to do an ad read,” she said. “So with that, the roof over my head has been brought to you by Polymarket.”

Musk and St. Clair first connected on X and began their relationship while working together in San Francisco shortly after, she told the New York Post in February.

On Feb. 14, St. Clair announced on X that she and Musk share a son who goes by R.S.C., though it wasn’t until April that his first name was confirmed to be Romulus.

St. Clair is now suing for sole custody of their son. In March, Musk, who is also the father of 13 other kids, denied St. Clair’s claims that he “financially retaliated” against their child. He said on X that “despite not knowing for sure” if the child is his, he’s given her child support and “given Ashley $2.5M and am sending her $500k/year.”

St. Clair responded to Musk’s tweet, saying he “refused” to get a paternity test. “Elon, we asked you to confirm paternity through a test before our child (who you named) was even born.”

“And you weren’t sending *me* money, you were sending support for your child that you thought was necessary… until you withdrew most of it to maintain control and punish me for disobedience,’ ” she continued. “But you’re really only punishing your son.”
